Agenga Nanguba MCA Evans Barasa election victory upheld

Agenga Nanguba Member of the County Assembly  in Samia Sub County  Evans Barasa’s victory in the August 8th, 2017general elections  was upheld by a Busia Court on Wednesday.A voter Ibrahim  Aruna Aramadhani had moved to court citing four grounds including propaganda  and malicious rumours  by the first respondent  against his closest challenger  and former Busia County Assembly Liaison Officer Camulus  Obada.While dismissing the petition, Senior Resident Magistrate Martha Nanzushi said the petitioner failed  to prove his case  to the required standards  for reasons already given.The petitioner shall bear costs  of the petition  which were capped at  Sh500,000 in total  pursuant to rule 34 of the Elections (Parliamentary and County  Elections) Rules 2013.The petitioner  had  prayed for recount  and scrutiny of votes  but the Magistrate in her ruling  said the petitioner failed  to lay basis  to warrant the court  to grant the order.” Ordering  for the same  would be a fishing expedition, where petitioner  hope to come up  with evidence to support  his claim. Although the margin  in this case is narrow as imagined, a win is a win  even by a single vote if the process is free, fair and verifiable,” she said.Barasa who had stood on Labour Party of Kenya ticket got 3340 votes with Obada (Independent) garnering 3138 votes in the elections that attracted nine candidates.
